The Special Judge for CBI Cases, Bhopal has sentenced Shri R. T. Bains, then Assistant Director, Horticulture, CPWD, Bhopal to undergo three years Rigorous Imprisonment with fine of Rs.50,000/- and Shri Abhishek Singh Gaur, Proprietor of M/s Yuva Constructions, Engineering & Consultant, Bhopal to undergo three years Rigorous Imprisonment with fine of Rs.30,000/-
CBI had registered a case U/s 120B, 420, 468, 471 of IPC and Section 13 (2) r/w 13 (1)(d) of PC Act, 1988 on 30.04.2009 against Deputy Director, Horticulture, CPWD Division, Bhopal; Assistant Director, Horticulture, CPWD, Division, Bhopal; Proprietor of M/s Yuva Constructions, Engineering & Consultant, Bhopal; a Contractor and others. It was alleged that said officials of CPWD & other unknown officials of CPWD during the year 2007-09 entered into criminal conspiracy with private persons including Proprietor of M/s Yuva Constructions Engineering & Consultant, Bhopal and fraudulently passed the forged/false bills submitted by the private person without supplying the plants, pots, manure & black cotton soil at Security Paper Mill (SPM), Hoshangabad and also by not carrying out the work of rockeries & landscaping at various sites of CPWD at Bhopal. An alleged loss to the tune or Rs.8,22,791/- (approx) was caused to the CPWD.
A charge sheet was filed on 14.07.2010 against the accused persons in the Court of Special Judge for CBI Cases, Bhopal.
The Trial Court found the said accused persons guilty and convicted them.
