THREE TO FIVE YEARS RIGOROUS IMPRISONMENT TO THEN THREE ENGINEERS OF MCD AND OTHERS IN A CORRUPTION CASE

The Special Judge, Patiala House Courts, New Delhi has convicted Sh. Suresh Kumar Lakra, then Assistant Engineer; Jaibir Sherawat, then Junior Engineer; Umesh Parashar, then Junior Engineer; Virender Pal, then Mate, all from Municipal Corporation of Delhi (MCD) and two private persons Piyush Goel & Mukesh Gupta. The Court sentenced Suresh Kumar Lakra & Jaibir Sherawat both to undergo five years Rigorous Imprisonment with fine of Rs. 60,000/- each; Umesh Parashar & Mukesh Gupta both to undergo three years RI with fine of Rs. one lakh each; Virender Pal to undergo three years RI with fine of Rs. 30,000/- and Piyush Goel to undergo five years RI with fine of Rs. one lakh.

CBI had registered a case on 20.05.2009 u/s. 120-B of IPC r/w. 7, 9, 12, and 13(2) r/w 13(1)(d) of PC Act 1988 on the allegations that during the period November-December 2008, certain officials of  MCD, Delhi, while working in Karol Bagh Zone of MCD, New Delhi, entered into a criminal conspiracy amongst themselves and two private persons Mukesh (a middleman) & Piyush Goel. The said officials of MCD and middlemen were running a racket to extract money from various building owners in Karol Bagh, New Delhi area in lieu of inaction against illegal construction etc. The accused public servants had adopted a unique modus-operandi and permitted unauthorized construction; allowed illegal commercial activities in residential areas & facilitated de-sealing of earlier sealed properties etc in lieu of illegal gratification. The officials of MCD demanded and accepted bribe to the tune of Rs. 17 lakh (approx) from Shri Piyush Goel.

After thorough investigation, a Charge Sheet was filed before the Special Judge, Patiala House Courts, New Delhi on 18.12.2009 against Sh. S. K. Lakra, then Assistant Engineer; Jaibir Sherawat, then JE; Umesh Parashar, then JE; Virender Pal, then Mate, all from MCD Delhi & two private persons Piyush Goel & Mukesh.

The Trial Court found the accused persons guilty and convicted them.
