Supreme Court’s decision on demonetisation

The BJP and the Congress have started making rhetoric against each other as soon as the Supreme Court ruled in favor of the Central Government with a majority of 4:1 on demonetisation. Former Finance Minister P Chidambaram said the minority verdict pointed out illegalities and irregularities in demonetisation. He said that the 4:1 majority verdict has clarified the question whether the objectives of demonetisation have been achieved? Chidambaram said that we are happy that the minority verdict has pointed out the illegality and irregularities in demonetisation. This is a slap on the face of the government. He said the dissenting judgment would go down in history as one of the most famous dissents in the history of the court.

On Chidambaram’s statement, senior BJP leader Ravi Shankar Prasad said, what’s the matter, the majority is silent on the judgement, but the minority is saying that it was slapped. Congress party is anti poor. The biggest benefit of demonetisation has been to the poor. Prasad further said that the question to Rahul Gandhi is whether you will say sorry now.

Congress had started a campaign against demonetisation and now the court has accepted this decision as correct. In fact, the constitution bench of the Supreme Court has justified the decision of the central government to close the notes of 500 and 1000 rupees in 2016. The Constitution Bench, in its majority judgment, said that the decision-making process of demonetisation was not flawed. Justice BV Nagaratna, however, questioned the government’s decision. Congress leaders are talking about this disagreement. Ravi Shankar Prasad said that the Supreme Court has dismissed all the petitions challenging the legality of demonetisation.

This whole exercise was done to stop black marketing to stop fake currency terror funding. Its purpose was right, the government has the right to take a decision. The court also accepted that the RBI was consulted. The court found the entire decision making process correct. Prasad further said that a Justice has given a dissenting judgment but he has also said that the intent and policy of the policy was correct. He said that the objective of demonetisation is also the welfare of the poor, we have been saying this time and again. The BJP leader said that there has been transparency due to demonetisation and there has been a spurt in digital payments. After demonetisation, 2 lakh 38 thousand shell companies were caught. The component of the informal sector in India’s economy has reduced from 52% to 20%. Demonetisation has done a great job in breaking the backbone of terrorism.

On the other hand, the Congress said that it is completely misleading and wrong to say that the Supreme Court has justified demonetisation. Party general secretary Jairam Ramesh said in a statement that the apex court has given its verdict on whether Section 26(2) of the Reserve Bank Act 1934 was implemented correctly before the announcement of demonetisation. He alleged that demonetisation was a disastrous decision which halted economic progress and resulted in loss of lakhs of jobs. Jairam Ramesh said that nowhere in the court’s decision has it been said whether the objectives of demonetisation were fulfilled or not. The court said on Monday that the central government’s decision to demonetise the Rs 500 and Rs 1,000 series notes in 2016 cannot be justified. A five-judge constitution bench headed by Justice SA Nazeer said that the decision in this regard was taken after consultations between the Reserve Bank of India (RBI) and the government. PLC/GT
