The Special Judge, CBI cases, Karkardooma, Delhi has convicted Sh. Dharamvir Khattar, then President of Bhairon Mandir Samiti, Delhi & then Chairman Hari Chand Prakash Wanti Trust; and Sh. M.K. Sharma & Sh. K.M. Johri both then Junior Engineers of Delhi Development Authority (DDA) in a case of cheating & criminal misconduct. The Court sentenced Sh. Dharamvir Khattar to undergo 07 years Imprisonment with a fine of Rs. One crore and Sh. M.K. Sharma & Sh. K.M. Joshi both to undergo 3 ½ years Imprisonment with fine of Rs. Five lakh each. The Court also passed orders for the CBI to take possession of the authorized premises of Bhairon Mandir Samiti located at East Patel Nagar, Institutional Area Delhi and hand it over to Chairman, DDA, Delhi.
CBI had registered the instant case on the allegations that Sh. Dharamvir Khattar entered into criminal conspiracy with two junior Engineers of DDA and other unknown officials of DDA in order to cheat the government by using the premises of Bhairon Mandir, Samiti and Hari Chand Prakash Wanti Trust as a hotel against the declared land use for religious purposes.
After investigation, a charge sheet was filed against the accused persons u/s 120 B r/w 420 of IPC and Sec. 13(2) r/w 13(1)(d) of P.C Act, 1988.
The trial court found the accused persons guilty and convicted them.
