NIA Files Charge-Sheet in Case Relating to Hijacking of a Tamil Nadu Government Bus

The National Investigating Agency (NIA) today filed a charge-sheet in Crime No.5/10 dated 22/01/2010, registered by it corresponding to FIR no. 469/05 dated 09.09.05 of Kalamassery Police Station, Ernakulam District, Kerala.

The allegations in brief were that on 9.9.2005 a Tamil Nadu Government Bus bearing number TN-01-6725 carrying passengers from Ernakulam, Kochi, Kerala going to Salem (Tamil Nadu) was hijacked by unknown accused persons by pointing a pistol and knife and after taking the bus to a lonely isolated place called Popmala, within the HMT colony, they set it on fire. The accused persons thereby displayed their hatred against the State which was the outcome of the conspiracy to wage war against the State.

During a thorough and exhaustive investigation conducted by the NIA, it was established that accused persons, namely : Umar Haji @ Naseer T (prime accused in the Bangalore blast cases and Eddakad case involving training of terrorists in Kashmir) , Halim, Bomb Ismail, Shafeeque , Sabir Buhari, Navas , Tajuddin, Nazar K, Anoop , Soofia Ma Adani, Umar Faroque, Abdul Rahim, Majid Parambai and Mohammad Sabir @ Ayub (total number -14) had entered into a criminal conspiracy to wage war against the State by criminal force against the decision of the State of Tamil Nadu to imprison their leader, Abdul Nassar Ma Adani (an under trial accused in judicial custody and involved in the Coimbatore blast case) and for putting pressure on the State of Tamil Nadu, so as to secure their leader’s release from Coimbatore Jail in Tamil Nadu and in furtherance of the said conspiracy they committed the crime.

Based on the evidence collected during investigation a prima facie case has been well established and the National Investigation Agency today submitted a Charge Sheet against the above noted accused persons [except accused Abdul Rahim who has since expired in an encounter in J & K] before the Special Court of NIA at Ernakulam after obtaining statutory sanction for prosecution from the competent authority of the Govt. of India.
