The Special Judge for CBI Cases, Bangalore has convicted Shri Dhirendra Kumar Jha, then Additional Commissioner of Income Tax, Bangalore & Shri U.A. Chandramouli, then Deputy Commissioner of Income Tax, Bangalore and sentenced them to undergo five years rigorous imprisonment with fine of Rs.7,50,000/- each for causing loss of Rs.4.16 crore(approx) to Government Exchequer.

CBI had registered a case on 26.09.2008 against Sh. U.A Chandramouli, then Deputy Commissioner of Income Tax, Bangalore & Chairman of M/s. Children’s Educational Society, J.P. Nagar, Bangalore U/s 120-B, 218, 420 of IPC and Sec. 13(2) r/w 13(1)(d) of PC Act, 1988. After completion of investigation, a charge sheet was filed on 21.04.2010 against Sh. U.A Chandramouli, then Dy. Commissioner of Income Tax, Bangalore; Chairman of M/s. Children’s Educational Society, J.P. Nagar, Bangalore & Shri. Dhirendra Kumar Jha, then Addl. Commissioner of Income Tax, Bangalore alleging that the public servants had entered into a criminal conspiracy with the Chairman (private person) in the assessment of income tax of M/s. Children’s Education Society and fraudulently returned a key document reflecting financial transactions of M/s. Children’s Education Society with Bangalore based constructions company without retaining the copies on record. The assessment of M/s. Children’s Education Society for the financial year 2003-04 was carried out on 22.12.2006 by the said officials of Income Tax Department, ignoring the aforesaid transactions and reducing the tax liability which had caused an alleged loss of Rs.4.16,21,067/-(approx) to the Income Tax Department(Govt. of India) and corresponding gain to the assessee. The Chairman of M/s. Children’s Educational Society, J.P. Nagar, Bangalore expired during the trial. Hence, the case against him was abetted.

The Trial Court found both the Additional and Deputy Commissioner of Income Tax guilty & convicted them.
