CBI had registered the case on the orders dated 09.07.2015 & 11.09.2015 of Hon’ble Supreme Court of India and taken over the investigation of the case, earlier registered vide FIR No. 591/12 dated 30.09.2012 at Police Station-Janakganj, Gwalior against Brijesh Kushwaha, U/s 419, 420, 176 of IPC and Section 3/4 of Madhya Pradesh Recognized Examinations Act, on a complaint from the then Centre Superintendent and Principal of P.G.V. College, Gwalior. It was alleged that during the written examination of PCRT 2012 on 30.09.2012, the photograph on the admit card of candidate Laxman Jataw Roll No. 272455 was not matching with the candidate who appeared in the examination.
CBI investigation revealed that candidate Laxman Jataw entered into conspiracy with the middleman and the impersonator with an intention to qualify PCRT-2012 examination with fraudulent means. In pursuance of said conspiracy, the accused Brijesh Kushwaha (impersonator) appeared in the PCRT 2012 examination on 30.09.2012 in place of the candidate Laxman Jataw under Roll No. 272455, knowingly, pretending and representing himself to be Laxman Jataw and was caught by the invigilators due to the suspicion over his identity. After investigation, CBI filed a charge sheet on 02.09.2016 against three accused i.e. impersonator, middleman and candidate.
The Trial court, Vyapam Cases, Gwalior held the accused namely Laxman Jataw (the candidate) and Brijesh Kushwaha (the impersonator) guilty. The Court convicted both the accused and acquitted the middleman.
