Delhi High Court Rejects Second Petition to Remove Arvind Kejriwal as Chief Minister

New Delhi : Delhi Chief Minister Arvind Kejriwal has got a big relief from the court. Delhi High Court has rejected the petition in which Kejriwal had been demanded to be removed from the post of CM of Delhi. The Delhi High Court refused to entertain another PIL seeking directions to remove Arvind Kejriwal from the post of Delhi Chief Minister. During the arguments, the Delhi High Court, while making oral observations, said that sometimes, individual interest has to be subordinated to the national interest. In the petition filed by Vishnu Gupta, president of an organization called Hindu Sena, a demand was made to remove Kejriwal from the post of CM, citing his arrest in a money laundering case related to the Delhi Excise Policy scam.

However, a division bench of Acting Chief Justice Manmohan Singh and Justice Manmeet Pritam Singh Arora said it would be Kejriwal’s personal decision whether to continue as chief minister or not. Still, the bench did give a subtle hint. It commented that “Sometimes, personal interest has to be subordinated to national interest but this is his (Kejriwal’s) personal decision.

However, the Court made it clear that it cannot take a decision on the matter. It is up to the Lieutenant Governor (LG) of Delhi or the President of India to decide on this issue. The court further said that they do not need our advice. LG will work only as per law. Vishnu Gupta, who filed the petition, told the court that now he wants to withdraw this petition. Now we will file our appeal with the Lieutenant Governor.

Arvind Kejriwal was arrested by ED on March 21. Kejriwal will currently remain in judicial custody till April 15. However, Delhi Chief Minister Arvind Kejriwal filed a petition in the High Court against his arrest. On Wednesday, the hearing on Kejriwal’s petition lasted for three hours. However, the High Court had reserved its decision after hearing both the sides. The court can decide today whether Kejriwal should be granted bail or not.
