The Central Bureau of Investigation filed a chargesheet against the then Principal Secretary, Medical Health & Family Welfare, Govt. of U.P(an IAS Officer); the then Managing Director & the then General Manager(Commercial), both of Uttar Pradesh Project Corporation Ltd. (UPPCL); a Ghaziabad based private firm and its Managing Director; and the then Minister, Family Welfare (Govt. of U.P) and the then MLA of Uttar Pradesh in the Court of Special Judge for CBI cases, Ghaziabad (U.P) for causing a loss of Rs. 6.02 crores (Approx) in a case relating to alleged irregularities in the implementation of the National Rural Health Mission (NRHM) funds Uttar Pradesh.  The CBI had earlier registered five Preliminary Enquiries relating to alleged irregularities in the execution & implementation of National Rural Health Mission funds in the State of UP since its inception in the year 2005-06 till November 2011 on the directions of Allahabad High Court, Lucknow Bench passed vide order dated 15.11.2011. On the basis of the findings in one of the five PEs, a case was registered on 18.01.2012 u/s 120-B r/w 420, 465,468,471 IPC and u/s. 13(2) r/w 13(1)(d) of PC Act 1988 against an IAS, the then Principal Secretary, Health & Family Welfare, (Govt. of UP) Lucknow & others for cheating the NRHM funds for construction of Modular OTs and setting up of AC/Air handling unit in 36 district hospitals.  The investigation revealed that the then Principal Secretary, Health & Family Welfare & Chairman of the Executive Committee of the State Health Society, NRHM (Uttar Pradesh) had conspired with the then Minister for Family Welfare as well as Cooperative, Uttar Pradesh ; the Managing Director of Ghaziabad based private firm ; the then MLA, of UP ; the then MD, UPPCL ; a General Manager, (Commercial) UPPCL, and the firm through its MD with an intention to cheat the NRHM funds for up-gradation of 36 district level hospitals on the basis of forged & bogus documents. In pursuance of the said criminal conspiracy, the accused public servants, had abused their official positions & in conspiracy with private co-accused persons and the Ghaziabad based private company cheated the NRHM funds to the tune of Rs. 6.02 Crores(Approx) by way of supply/installation of Modular OTs and AC units in 36 District Level Hospitals in the state of UP on exorbitant rates which were obtained from a Ghaziabad based private firm. Further investigation also revealed that the involvement of accused persons & private firm resulted not only in derailment of the scheme meant for the needy & weaker sections of the society but also caused a loss to the Government exchequer.  The public is reminded that the above findings are based on the investigation done by CBI and evidence collected by it. Under the Indian Law, the accused are presumed to be innocent till their guilt is finally established after a fair trial.
