The Special Judge, AHD, CBI, Ranchi has sentenced 29 accused persons in one of the Fodder Scam Cases.
The 29 accused persons sentenced are: Jivendra Narain Choudhary, the then ATO Doranda Treasury Ranchi to undergo three years Rigorous Imprisonment with total fine of Rs.Two lakh; Devendra Prasad Srivastara, the then TO Doranda Treasury Ranchi to undergo three years Rigorous Imprisonment with total fine of Rs.Two lakh; Mahendra Prasad, the then TO Doranda Treasury Ranchi to undergo three years Rigorous Imprisonment with a fine of Rs.Two lakh; Subhashish Deb of M/s Shree Ram Enterprises, Jamshedpuri to undergo two years Rigorous Imprisonment with total fine of Rs.Fifty thousand; Naresh Prasad, Prop of M/s Vyapar Kutir, Natraj Gali, Bakarganj Patna to undergo three years Rigorous Imprisonment with total fine of Rs.One lakh; Sudhir Kumar Sinha, Prop of M/s Anurag Medical Agency, Hazaribagh to undergo two years Rigorous Imprisonment with total fine of Rs.Twenty Five thousand; Pankaj Saran, Prop of M/s Archana Drugs, Patna to undergo one year Rigorous Imprisonment with total fine of Rs.Twenty five thousand; Sameer Walia, Prop of M/s Care & Cure, Ranchi to undergo three years Rigorous Imprisonment with total fine of Rs. In this case, chargesheet was filed against a total of 111 accused persons for fraudulent withdrawal of Rs.47,17,70,000/- from Doranda Treasury during the Financial Year 1990 and 1995 on the basis of forged & fabricated allotment letters and spurious bills. The false bills were showed the supply of various items like yellow maize, pigfeed, fish meal etc. to milk supply-cum-dairy farm of Animal Husbandry Department, Hotwar, Ranchi.
Out of a total of 111 accused persons, who were sent up for trial, 18 accused persons died during trial. They were: Dr. Ram Raj Ram, the then Director, AHD, Patna; Late Dr B. Pasad, Ex Regional Joint Director, AHD, Ranchi; Dr Shyam Bihari Sinha, the then RJD AHD, Ranchi; Dr. Chandra Bhushan Dubey, the then Piggery Development Officer, AHD, Patnar; Dr. Shakti Shankar Verma, the then Manager, PBF Kankey and PBF Hotwar, Ranchi; Dr Madan Kumar Sinha, the then Manager, PDU Hotwar under PBF Hotwa; Dr Shyamal Kishore Sharma, the then Manager, GCF Hazaribagh; Rup Narayan Prasad, the then ATO Doranda Treasury, Ranchi; Harish Khandelwal, Partner of M/s AB Sales Ranchi; Santosh Kumar Sinha, Prop of M/s Anshuman Enterprises, Kolkata; Virendra Nath Tiwary, Director of M/s Baphar Loboratories Pvt Ltd. Muzaffapur, Bihar; Paresh Chandra Kundu, Partner of M/s Sarweshwari Drug Agency, Ranchi; Kamlesh Kumar H/o Smt Sulekha Devi, Prop M/s Shree Shankar Drug House, Ranchi; Shri Ishwari Prasad Jaiswal, Prop of M/s Jaiswal Stores, Ranchi; KP. Md. Osman, Prop of M/s K.P. Md Osman, Kolkata; Pramod Kumar Dubey, Prop M/s Shiv Shankar Cattle Feed Industries,Ranchi; T.N. Pathak, the then Accounant Doranda Treasuary, Ranchi and R.K. Mistry, the then Scrutiny Clerk, Doranda Ranchi.
Two of the accused, namely P.K.Jaiswal (Supplier) and Sushil Kumar Jha Partner of M/s Shree Gouri Distributors Bhagalpur & Ranchi were convicted earlier after they pleaded guilty. One accused namely Dipesh Chandak Prop. / Managing Director of M/s Laxmi Trading Co, PO Mahilong Tatisilwai Ranchi was granted pardon after he was made an approver.
Four of the chargesheeted accused are absconding. These are: Chinta Verma, Prop of M/s A.K. Enterprises, Patna; Bal Krishna Sharma,Prop of M/s Shree Gauri Agency, Bhagalpur; A.K. Choudhary, Prop of M/s S.M. Enterprises G.M. Road, Patna and Rajesh Sharma, Prop of M/s R.K. Transport, Purulia, Ranchi.
Out of the remaining 86 accused persons, who were facing trial, 16(Sixteen) accused persons were acquitted for want of evidence. These are: Dr B.B. Singh, the then PO, IP DB, Simdega; Dr M.P. Verma, the then DAHO, Lohardaga; Jai Shankar Mishra, of M/s Bharat Agency, Ranchi; Anil Kumar Sinha, Partner of M/s Hi Tech Veterinary Care Ranchi; Naresh Kumar Agarwal, Prop of M/s Medico Agency, Ranchi; Pankaj Kumar Pandey, Prop of M/s Sharda Drugs, Ranchi; Abhay Kr. Sinha, Prop of M/s S.S Drugs, Ranchi; Rakesh Kumar of M/s Surgichem Pharmaceuticals, Patna; Ram Avtar Sharma, Patna Prop M/s Tirupati Agnecy Abhishek Plaza, Patna; Jitendra Kumar, Prop of M/s Kuldeep Enterprises, Ranchi; S.P. Sahu, the then Accountant Doranda Treasury, Ranchi; Rajendra Pandey, the then Accountant Doranda Treasury Ranchi; M. Mishra, the then Accounant Doranda Treasury, Ranchi; D.N. Sahay, the then Secrutiny Clerk Doranda Treasury, Ranchi; R.S, Sahu, the then Scrutiny clerk Doranda Treasury, Ranchi and U.P. Singh, the then Scrutiny Clerk Doranda Treasury, Ranchi. One accused person, namely Dr. Sidhi Nath Pandey did not turn up. The Trial Court has issued Non Bailable Warrant. Out of 69 convicts, the court awarded sentence to following 29 accused persons.
The case has been adjourned to 07.05.2012 for award of sentence to remaining 40 convicts.
This is 42nd case so far disposed off from trial by the Special Court at Ranchi.
