NIMC Takes Action Against Three Clinics in Delhi for PC & PNDT Act Violations

The National Inspection and Monitoring Committee (NIMC), under the PC & PNDT Act, 1994, has sealed ultrasound machines in two of the facilities and a show-cause notice was issued to the third facility for violations under the Act. The NIMC inspected three clinics in South and South-West districts of NCT-Delhi for random field inspections of ultrasound clinics/facilities on 29th August 2011. The team comprising of members from Ministry of Health & Family Welfare, Ministry of Law and civil society, along with Appropriate Authorities from the State, undertook verification of equipment and examination of records valid under the PC & PNDT Act. The details are as follows:

1. K. L. Chest Diagnostic Clinic, Munirka, New Delhi- The ultrasound machine being used for Obstetric ultrasound procedures was sealed by the designated Appropriate Authority due to non-maintenance of prescribed records including blank F-Forms and under-reporting of procedures (no Form-F maintained in several cases for diagnostic tests performed).

2. Modern Diagnostic Centre, Tughlaqabad Extension, New Delhi- The single ultrasound machine in the clinic was sealed by the inspection team for lack of proper maintenance of records. Records of the clinic were also seized by the Appropriate Authority.

3. Fortis La Femme, GK-II, New Delhi –The hospital was inspected and relevant records were examined by the team. The facility was issued a show-cause notice to explain why two of their radiologists conducting ultrasound procedures were not registered with the District Appropriate Authority as per the Act.

The Central Supervisory Board under the chairmanship of Union Minister of Health & FW, Shri Ghulam Nabi Azad in its meeting held on 4th June, 2011 had decided to empower the National Inspection and Monitoring Committee (NIMC) to ensure effective action against clinics/facilities found prima facie guilty of violating the provisions of the Act.
