Election to the Legislative Council of Andhra Pradesh from Hyderabad and Ranga Reddy Local Authorities’ Constituencies

The Andhra Pradesh Legislative Council Act, 2005 was passed on 11^th January, 2006, for the constitution of a new Legislative Council in the State comprising 90 members – 31 to be elected by the Members of Legislative Assembly, 31 from Local Authorities’, 8 from Graduates’, and 8 from Teachers’ Constituencies and 12 nominated members.

2. The elections to the Andhra Pradesh Legislative Council for 75 seats out of 78 seats to be filled by election were held in the year 2007; and

3. The elections to the Andhra Pradesh Legislative Council for remaining 3 seats namely, 2 (two) seats from Hyderabad Local Authorities’ Constituency and 1 (one) seat from Ranga Reddy Local Authorities’ Constituency, could not be conducted due to non-existence of the required number of Local Bodies / electors constituting the electorates in those Constituencies.

4. The Local Bodies Elections to the GHMC have been completed recently and the required number Local Bodies and the electors of Hyderabad Local Authorities’ and Ranga Reddy Local Authorities’ Constituencies are now in position at present.

5. In view of the above, the Election Commission has decided to hold Elections to the Andhra Pradesh Legislative Council for the purpose of filling up the said three seats, from the following Local Authorities’ Constituencies :-

6. Accordingly, the aforesaid Elections will be held in accordance with the following programme :-

Further, since the elections to fill these three seats are part of the election for the initial constitution of the State Legislative Council, the Governor of Andhra Pradesh has been pleased to give his concurrence under Section 156(1) of the Representation of the People Act, 1951 that, after the elections to fill these three seats, the terms of members so elected shall be determined, by draw of lots, in the following manner, so as to synchronise with the cycles of biennial retirement of 23 Members belonging to the Local Authorities’ Constituencies elected in 2007 whose terms of office started from 2^nd May, 2007 under Section 157 of the said Act:-

(i) the term of one Member will be from the date of the notification under Section 74 of the Representation of the People Act, 1951 and till 1^st May, 2011

(ii) the term of second Member will be from the date of the notification under Section 74 of the Representation of the People Act, 1951 and till 1^st May, 2013

(iii) the term of third Member will be from the date of the notification under Section 74 of the Representation of the People Act, 1951 and till 1^st May, 2015.

8. The Model Code of Conduct will come into force with immediate effect in the Constituencies going to elections.
